How did the fight start in the DLSU Inc. Vs. Court of Appeals?
Before James Yap’s class, he went out of the campus through the Engineering Gate to buy candies across Taft Avenue. As he was about to return to the campus, he was met with eight to ten guys running towards him and beat him up severely. Among the assailants were Bungbung, Reverente, Lee, Valdes and Aguilar. After being beaten up, Yap was then escorted by two guards back to the campus, brought him to the clinic and reported the incident to the Discipline Office. He then reported to his fraternity members and their leader, Mr. Pascual told them to do nothing. Cano, Perez and Pascual departed from school and decided to head home but before doing so, they went to Dagonoy Street because Pascual has to retrieve a book from a friend. While they were along the street, they saw several guys inside the Kolehiyo ng Malate Restaurant. Among the guys identified were respondents, Lee and Valdes. The petitioners tried to prevent a brawl from happening but Lee hit Cano in the face. They were outnumbered and were beaten up however Cano and Perez managed to escape. On March 30, 1995, James Yap filed a complaint with the Discipline Board of De La Salle University charging the private respondents with direct assault.
