The National Medical Admission Tests is intended to narrow down and regulate the students to be admitted in medical schools in order to ensure competence. It is the responsibility of the State has the choice to establish tests to ensure the quality of medical education in the Philippines. This is also a step taken in order to secure public health, safety, and welfare. However, the right to quality education is not absolute. The Constitution provides that every citizen has the right to choose a profession or course of study, subject to fair, reasonable, and equitable admission and academic requirement. The petition has been granted and the decision of the respondent court has been reversed. Respondent Judge Teresita Dizon-Capulong ruled that the MECS Order No. 12, Series of 1972 was invalid and held that the petitioner had been deprived of his right to pursue a medical education through an arbitrary exercise of the police power.
